What to do when you get a HIT on your NBI clearance

UPDATED January 2020

Department of Justice (DOJ) Circular 017, or the multi-purpose clearance does away with the usual separate applications for domestic employment, travel abroad, gun licensing and many others, thereby making it easier for people to obtain and use an NBI clearance.


Are you applying for your NBI clearance?

The National Bureau of Investigation office has stopped entertaining walk-ins after the implementation of the fully online application process for NBI clearance.

The registration and appointment system for the NBI clearance are done online nationwide. Applicants may accomplish the application form at www.doj.gov.ph/nbi, www.nbi.gov.ph, and clearance.nbi.gov.ph.

After registering online, applicants may proceed to any of the NBI sites nationwide for the payment and biometric enrollment before their their clearance is released.

Here's the catch.

What if you suddenly get a "hit" when you are about to claim your clearance?

Namesakes and Criminal Cases

When you get a "hit" it means either you have a namesake or you may have a pending criminal case in court.

For your peace of mind, civil cases such as money claims, ejectments, annulments, etc. are not included.

However, the "hit" entitles you to a one-week waiting time. That is the length of time that NBI researchers will verify if the name on the "hit" list is really you or if there are any other pending criminal cases under your name. So, if you got "hit" - for example on the 27th of June - you'll be asked to go back on the 4th of July.

Quality Control is at NBI Taft Avenue

When you return on the date specified on your receipt, if your clearance is still not available, the clerk at the counter will now tell you to proceed to NBI Main along Taft Avenue, Manila so you'll be interviewed by their Quality Control staff. If you're in a distant region, say in the Visayas region, the staff will tell you where their nearest quality control office is located.


How to get to the NBI Manila Quality Control office

You can get there either by riding the LRT and drop off at the UN Station, or driving all the way via Espana Boulevard, left to Lacson (formerly Forbes) then right towards Paco.  Go straight until you reach Taft corner UN Avenues, the NBI Main Office.

Parking spaces are scarce at the NBI office so it's best to have an alternate driver with you so he can stay and watch your car while you're inside. If you have a motorcycle, it's best to ditch your car for a while and use your motorbike instead.

Once inside the building, proceed to the Quality Control "QC" section.

Inside, there's a line waiting for you so you have to be patient. You can always bring your smartphone with you so you can tinker with it versus boredom. When you hear your name in the PA system, stand up and approach the QC interviewer.








Sworn Affidavits for Namesake Issues, Disposition Clearances and Court Decisions

If you have a namesake, there is an NBI in-house lawyer whom you will be asked to subscribe upon. You will be executing an affidavit and attest under oath that what appeared on their record is just your namesake.

It's an affidavit, a legal instrument, that's why Mr. Lawyer is there to put his signature into. After signing your affidavit, you can now claim your NBI clearance.

However, if the NBI staff says you have an existing criminal case, you will be asked to proceed to the court of origin and get a Disposition Clearance/ Court Decision.

If there is no Decision yet and your case is still active, you cannot claim your NBI clearance.

Warrant of Arrest

But, what if there's an existing warrant for your arrest and isn't lifted yet?  Will NBI agents suddenly swarm at you and arrest you?

Probably not because they don't have the actual warrants with them. And they don't know if such warrants are still active or not. What they have there are just a list of names of people with pending cases. If you're a bit skeptic, you can send a representative in your behalf.  Give your rep an Authorization Letter and at least two of your valid ID's.


Go to the court of origin

If you do have a pending warrant, then you might want to post for your bail at the court of origin. The case won't move unless you post bail and undergo court proceedings. If you have already posted bail before and is awaiting final judgment, communicate with the Clerk of Court. Of course, there is now a very slim chance to get a clearance if the case is still active.

Now, if the case is already over, get a copy of the judge's Court Decision. If it says CONVICTION, then you may have to consider appealing your case.

If it says DISMISSED or ACQUITTAL, bring the Decision to the NBI QC and claim your NBI clearance.

Effects of Criminal Cases on a Person's NBI Records

According to sources, criminal cases on one's NBI records seemed to be permanent and undelete-able, even when such cases are already done with and decided upon.

For example: If you already submitted court decisions (dismissed/acquittal) at the NBI QC office during the time when you previously applied for an NBI clearance, let's say in 2015 -- these cases shall appear the next time you apply for another one, giving you, again, a HIT. As such, your NBI clearance will be available to you only after a seven-day waiting time.


Auto-HIT for NBI Clearances with purpose "For Abroad" and "Firearms licenses"

Somehow, most applicants always get an auto-HIT whenever they apply a clearance meant for abroad. This also holds true on most applications for firearms licenses. There are no clear-cut rules or written protocols on these phenomenon, but most people think the rationale is quite obvious: to purge the NBI database from persons with criminal records and hold-departure orders (HDO).

Note: The 2017 circular makes the NBI Clearance a multi-purpose clearance and does away with "For Abroad" and "Firearms, LTOPF, Gun renewal, Gun registration" purposes.


The REMARKS Section - What is the difference between "No record on file" versus "No derogatory record," and others

At the bottom portion of the NBI Clearance is the REMARKS section. The agency usually gives out five phrases under this: “No record on file,  “No derogatory record,” or “With derogatory record,” and “No pending case” or “No criminal record”.

“No record on file” is written for an individual who has never obtained a Clearance; “No derogatory record” is indicated on Clearance renewals; and “With derogatory record” is indicated for those individuals who have an incident with the law.

The remarks “No pending case” or “No criminal record” means exactly as it says: an individual has no criminal record and he has no pending case under his name. But for immigrant visa applicants, only those individuals who are issued clearances that state “No pending case” or “No criminal record” are required to obtain an official explanation letter from the NBI prior to their interviews at certain foreign embassies.

    I have applied for an NBI clearance as one of the requirements in applying for a visa Canada. Sad to say i got a "HIT" on their computer files which i think is due to a case that was filed against me several years ago. I was accused of Reckless Imprudence Resulting in Damage to Property sometime 2009 and was proven innocent by an acquittal last year. I am worried and already expecting a "No Criminal Record" on my NBI clearance. I would like to ask for some advice on what steps to take to provide the Canadian embassy with necessary documents that they require when such remarks appears on an applicant's NBI clearance. According to the Canadian embassy's website they require An NBI certificate (Original Copy)
    issued within the last 3 months and marked with dry seal and your
    thumbprint (Personal Copy not acceptable). If any of the following
    remarks appear on the NBI certificate – NO CRIMINAL RECORD, NO PENDING CASE or RECORD AS STATED, please submit:
    A written explanation from the NBI regarding this remark;
    All court documents to the criminal charges. (** Please provide
    complete copies of the decision or the resolution of the case. Note that
    certifications from the clerks of court are not acceptable); and
    Your own explanation of the incident leading to the charges.
    How can I obtain a written explanation from the NBI regarding the remark on my NBI clearance? Will the NBI give it freely upon my request or will they require an official letter from the Canadian embassy?

  3. If I remember it right, I think NBI Quality Control is still in charge of this process. All you have to do is to present them certified true copies of the documents regarding your case -- just to prove that the case is already closed and you've been acquitted. And yes, you would need an official letter coming from the Canadian Embassy.

    Magkakaroon po ba kau ng hit kapag di nakapagfile ng ITR?
    Ever since na kumuha ako ng NBI, never pa po ako ngkaroon ng hit until recently. Dahil ngaun lang po ako nagkahit, at di nmn po masyadong common ung name ko, naiisip ko po baka kasi di ko nafile ung ITR ko last year dahil nagbago po ako ng company before ng filing date. Pero this year naman po ung bago kong company prinocess nmn po nila ung tax ko.

  7. It means you've been charged with a criminal offense in the past. The phrase is very much the same to a "No Criminal Record" and "No Pending Case" remark.

  8. hi good eve po.. Last 2012 nag apply po ako sa isang BPO company then we signed contract for 1yr.. The problem is nag AWOL po ako sa job after a month. Now I'm trying to get a new job and apply for an NBI clearance now my name got hit. Is it possible na nag file ng case ang dati kong company. Will it appear on the NBI records? What will I do? Kasi po nung 1st ko po kumuha ng NBI di naman nag hit yung name ko and it's been a year na din since umalis ako sa company.... Hope i will get you reply soon..... Thank you po.

  9. AWOL incidents fall under the category of administrative cases and will not cause a HIT on your NBI records. I suggest you return on the date specified so you would know what actually caused your HIT. If it's just a namesake, then you won't be having any problems getting your NBI clearance.

  10. hello, good afternoon, Sir. I just went to NBI this morning to process my NBI Clearance but unfortunately, to my surprised. I got a "hit". After the biometrics "with hit" flashed on the screen. BIgla akong kinabahan. I got my last NBI Clearance way back 2012 and it was clear. I think May of 2012. Ilang beses na po akong kumuha ng clearance at first time ko pong ma-hit. Bigla ko pong naalala na may loan po ako sa Chinatrust at di ko po natapus hulugan. At yon naman po ay way back 2010 pa. Nag-antay po ako ng demand letter from Chinatrust peru never po akong naka receive ng kahit anong sulat hanggat sa lumipat na din ako ng tirahan. Hindi ko na sila nabalikan pa. Nawalan po kasi ako ng trabahu that time due to recession kaya lumipat ako ng Maynila. Eto po mga tanung ko.


    1) Is it possible po ba na nag file na sila ng BP22 case saken in the year of 2012 or 2013 kaya po ako na hit? May 2012 po kasi nakakuha ako ng clearance?


    2) With regard naman po dun sa loan sa mga Cooperative na di naman po nag iissue ng check as collateral. Makakasuhan po ba ng BP22 o criminal case ang umutang?


    please pasagut naman po. Babalik ako sa NBI UN on March 13 to get the clearance. Sana namesake issue lang ito para makuha ko na clearance ko. I asked my friend na din po to get the clearance for me on my behalf since I am very skeptical to go there. masyado po akong kinakabahan. parang antagal ng May 13.

    1. If you issued bounced checks, then it's very possible that they may sue you for Violation of BP22, even at a later year like 2012 or 2013. If there were no bounced checks issued, then they cannot sue.


    2. Loans are treated as debts so they are classified as civil cases -- which means no problems for your NBI records.


    3. Yes, cases will still roll on even if the respondent was not able to receive his subpoenas.


    4. Yes, they can still file cases which happened years ago. It's called "prescriptive period."


    But don't fret yet. Based on your story, I think those loans weren't connected on the HIT that you got. It may be a namesake issue, or maybe you're applying for an "abroad" clearance; and if so -- then you'll be able to get your NBI clearance on March 13.

  14. Cash penalties, fines, failure to surrender IDs and other non-sensitive materials -- still fall under the admin/civil cases category. No problems with those. I'm pretty confident you'll be able to get your NBI clearance.

  17. Probably not. But, if you're a bit skeptic, you can always send somebody to go to Quality Control. Just have him bring an authorization letter and two of your valid IDs.

I need to get nbi clearance for local employment but my dilemma is this, I was convicted of a criminal case in singapore and time served was 3 wks then I was deported. my question is, will I still get a hit even if the crinal case was in singapore? pls enlighten me na paparanoid na po ako and im scared to go there to get clearance.

  23. Our NBI database only records offenses committed within PH territory and does not include offenses committed abroad -- not unless the crime was of grave nature that they have to inform the PH government of your case.


    Yours was only 3 weeks time served so it means it was a (very) light offense.


    No need to worry, you'll get your NBI clearance.

  25. HI po again! I was able to get my NBI clearance today, although really took me the whole day today to queue (from steps 1 to 5). Thank you again sir!


    I have another query sir, me and a friend went together to get our clearance, unfortunately, my friend did not get his. he was asked to come back on the 21st of march. He asked the lady who handed him his receipt the reason why he was being asked to come back. The usual reply was ( usual because a lot got 'WITH HIT" today), he has a namesake, but he is worried that this is not the case. he told me that in his previous company, he did something wrong, which involves money. But he also told me that the boss and him were able to talk amicably about this ( that is what he knows). But he is still worried and asked me to inquire to you about his case. His questions are:


    Is it possible that he has a case filed and not know about this?. Why is it that he never received any subpoenas or any letter/legal docs, if ever they have filed the case, is this also possible? He never transferred residence and never changed phone no.

    As to your friend's dilemma:
    Yes, it's possible, but very rare -- like when subpoenas were sent to wrong addresses or when a delivery guy was too lazy to look for a certain address.


    But your friend need not worry, these circumstances are very rare and it's probably in a 1:100,000 ratio. Plus the fact that he and his boss already settled amicably (basing on your story).


    Could be that he does have a namesake. I suggest he returns on the date specified so he'd know what actually caused his HIT. If it really is only a namesake, then I'm sure he can get his NBI clearance on March 21.

Hi po, i would just like to ask if non-payment of postpaid plan (still under lock-up period with existing balance) can be considered as a criminal record so as for the NBI personnel not to issue an NBI clearance? A friend of mine shared that there was a postpaid plan for internet under his name but it was still in its 14 months (contract period is 24 mos.) and was disconnected because of non-payment. Is there a possibility that the Telecom company filed a case to my friend because of this?

  29. Non-payment of post-paid plans are also considered as non-payment of debts, and therefore, fall under the category of civil cases.


    Even if the telecom company did file a case against your friend, this shall not reflect on his NBI records. He can get his NBI clearance.

    Last Feb. 24 2014,nakareceived po ako ng letter from the prosecutor office na nakahanap sila ng probable cause to charge me with the offense.

    So last March 3 2014, nagpunta ako sa cityhall para i-verify saan RTC branch napunta kaso ko.

    Sa mga criminal case tulad ng Bigamy, reflected na ba agad sa NBI kung kaka-akyat pa lang sa RTC? kahit wala pang sched.of hearing, wala pang arraignment o wala pang arrest warrant...Let say kukuha ako ng NBI clearance ngayon, HIT na kaya ang resulta ko? salamat po

  35. The criminal case will only reflect on a person's NBI record once the court issues a warrant of arrest and copy furnished to NBI Main. Meanwhile, the schedules of arraignment and pre-trial hearings are done only after a person posts his bail in court.

    I suggest you go and get your NBI clearance now ASAP, while the warrant is still pending in the court.

  36. i got a HIT at NBI. After 1 week, i returned and was interviewed and they told me that I have a pending case of "slight physical injuries" at Quezon City RTC. NBI clearance will be issued once I get a court clearance from the RTC. I insisted that they might have gotten it wrong, as i do not normally go to QC and have not done anything wrong. What should I do?

    My question is, pwede po ba ulit kumuha ng NBI clearance even kakukuha ko pa lamang because i really need it. Ano po ba dapat kong gawin kasi kahit saan sulok, hindi ko na talaga makita yung NBI ko na kakukuha ko lamang this day? Please help me po, Im already upset...

My friend has a problem getting his nbi because he's worried to get hit...my client kc siya na nkpag bigay ng cheque sknya for business kaso ang problem hnd ntpos ang uspan nila half lng ang ntpos niya.. Den nagusap sila s police station at pnpblik ung money n naibigay n sknya on that day mismo..but wla xa naibigay at nagbanta ung client niya na ide2manda siya kaso hnd nmn po alam ng client niya ang exact address niya name lng po niya ang alam.. At wla n pong iba..mg hit po b kaya un sa nbi niy?tn

  39. I suppose you have to go to that RTC branch and get that court clearance. Don't worry, if it's not really you they're looking for, then you'll not be having any problems getting one. Your namesake may be very similar to your profile, the reason why the NBI staff was asking you to get a court clearance. Don't worry, after this process, you can now get your NBI clearance.

  40. Yes, you can still get another NBI clearance, but you have to go through the whole process again -- fall in line, fill up an application form, undergo biometrics and have you picture taken. Of course, you have to pay for the fees again.

    Or you can try approaching their information desk and explain to them what happened so you don't have to fall in line again. If they will allow you to do that, then you're in luck. But, they may require you to get an affidavit of loss and/or a police report to show proof that you did lost your NBI clearance.

    And don't forget to bring with you your official receipt (OR).

  41. Did your friend receive a subpoena? Has he changed his residence since the incident? If his client did file a case against him. he'll surely receive a subpoena commanding him to appear in a prosecutor's office. But if he changed residence, then he won't be able to receive it.


    One more thing: the client can still file a case even if he doesn't know the address of your friend if he consults a lawyer -- lawyers are smart.

    It may or may not cause a hit. The only way to find out is for your friend to apply for an NBI clearance.

Sir magtatanung lng ako may friend kasi ako nagustong kumuha ng nbi kaso po nag aalin langan sya dahil ang pangalan nya ginamit ng friend nya sa pag utang ng pera sa bangko nuong don pa siya sa hongkong...tanung ko lang po kung sakaling kukuha siya ng nbi magkkaproblma po ba siya or ma hit siya sa nbi salamat po

  43. Well, it depends.


    If it was a simple loan or debt, then it'll be categorized under civil cases and this won't cause a HIT on your friend's NBI records.


    But, if your friend issued bank checks in applying and paying for the loan, and those checks bounced (Violation of BP 22), then this will be a criminal offense and will cause a HIT.


    Further, there's always a contract when getting a loan -- if the "fine lines" of the contract say that when payments were not made, the lending company will sue for fraud and deceit. If so, then this will also cause a HIT.


    Some loans are tricky, some are not.

  45. Am I correct in assuming that the loan was consummated in Hong Kong? If yes, then your friend won't be having any problems getting an NBI clearance. The NBI only retains case records which happened in the Philippines. Not unless the amount of loan is so huge, that the bank in Hong Kong will have to refer the case to NBI authorities.

  48. It depends on what their agreement said. The complainant may file a case of Estafa, which is a criminal case -- or breach of contract which is a civil case. It all depends on the complainant.

  50. from the first po kc alam nmn dw po ng client niya na non-refunable ang downpayment..naibili n din po ng materials at npshod n s mga gumwa nag karoon lng po ng problem sa araw..den he was invited at police station without warrant of arrest at dun po siya pna pirma ng contract na within that day n hnd mtpos ay iba2lik niya ang downpayment with 20% intetest po.but my friend insisted na ang kaya lng niya iblik is all the unfinish materials dhil ntpos nmn po ung half.. now he badly needed he's nbi for abroad business trip...but he was afraid n ma corner nnmn siya gaya sa police n pinapirma siy a ng documents ult n hnd inaashan..thanks for the advance advice..

  51. Well, the only way to find out is for your friend to apply for an NBI clearance. If he gets HIT, he can always ask somebody to get the details of his HIT, just let him bring along an authorization letter and two valid IDs.

    1. If the case is still undergoing preliminary investigation at the prosecutor's office -- NO HIT
    2. If the case is already at MTC/RTC -- WITH HIT


    Now, if your complainant is not attending the scheduled hearings, your lawyer may now move to DISMISS the case.

  58. If you were already arraigned, then it means the case is already with the MTC/RTC. This case shall now appear in your NBI records and will cause a HIT when you apply for an NBI clearance.

  60. You cannot get your NBI clearance if your case is still pending with the courts. If your complainant isn't attending the hearings anymore, you can move for the dismissal of the case. You can file a motion once the complainant fails to attend three consecutive hearings. Your lawyer can do this for you.


    Once dismissed, you can now get an NBI clearance.

    Second - If not, then there'll be no HIT.

  63. hi po...i have a question...my friend po kasi ako.....2012 po kasi,usap-usapan sa kanila na meron daw siyang arrest warrant for illegal drugs...di rin po niya na confirm kasi umalis daw siya sa kanilang lugar...nalaman nlang niya na meron siyang arrest warrant after ng ilang buwan...natakot rin siyang bumalik sa kanila dahil baka raw arestohin siya...at hanggang ngayon dili parin niya ma confirm kun totoo ba na meron siyang warrant o wala...ang sabi niya sa akin hindi raw siya nagbibinta ng druga,gumagamit lang siya.......sa ngayon po hinda na po siya gumagamit.......
    ang mga tanong po niya ay ito:
    1.kapag umuwi po ba siya sa kanilang probinsiya,may posibilidad po ba na arestohin siya after almost 2 years?
    2.kapag kumuha po ba siya ng NBI clearance,mag hihit po ba kahit di niya na recieved ang warrant?kasi po may balak kasing siyang mangibang bayan..

    Just want to ask something regarding NBI clearance. My cousin scammed 36k worth from a girl in Cebu. The girl traced the Smart account my cousin used and it was pointed to my name. My cousin was a drug addict plus he left Manila and we no longer have contact with him. The girl threatened me that she filed a complaint on NBI regarding this but I never received any notice from NBI. But I asked the girl for proofs and it really showed my ID which was my student ID back when I was in college. I ended up paying 36k to the girl just to clear my name but after that we never had an interaction. Also, she told me that she cancelled the NBI complaint. After a month, she messaged me on Facebook asking for 5k or else she will file again a complaint. I felt like she was just scamming me so I said a firm 'No.' After that, we never talked. But again, I never received any notice. Will I get a hit on my NBI clearance?

  69. No, it won't cause you a HIT as long as you're not included in the complaint against your husband. As for your friend's concern -- no, it won't affect his NBI if he gets his records corrected. Just tell him to bring a copy of his birth certificate, just in case.

  79. You can ask your lawyer (or a friend) to check court records on locations where you think someone filed a case against you. There's an electronic database in court lobbies where a person can type a name of another to verify if that person has a pending case or not.


    Now, if you do have a case, it's best to settle it before getting your NBI clearance.

  85. No, they have to be original valid IDs, and not photocopies. As for your concern about passports, an NBI clearance is not really a requirement when you renew your passport, it only acts as a supporting document if you don't have enough proof of identities.

  86. Yes, the case record may reappear again at NBI. If you want another copy of your court order, you can always go back to the court of origin and request for a copy. There's a minimal fee, though.

  88. If one has to read your story, it would seem the cause of all your woes is AF. Sad to say, because of AF's irresponsible actions, you may be sued in court and this can affect your NBI records.

    The good news is: There are legal remedies provided by law that can help you with your problem.

    In court parlance on the matters of money and debts, there is a phrase called "good faith."

    Why not sue AF for Estafa and/or Non-Payment of Debts? If sued by MF, you can always invoke "good faith" and tell the court it was not you who accumulated the 400K but it was really AF, proof of which is your filed complaint against AF. Point the finger to AF, you don't have to bear the brunt of all of these.

    As for MF and the agreement that you signed, you can always claim you were "under duress" when you signed such "agreement." On the extreme side, you can even sue MF for "Coercion" for forcing you to sign the agreement. In fact, your Mum can also sue for Coercion because of what MF and ALIAS did to her.

    But of course this is just an opinion. I advise that you get assistance from your own lawyer to help you with these.

  91. Being a witness does not give you a HIT on your NBI records not unless the judge issued a warrant for her arrest to force her to attend and testify. Tell your sister to return on the specified date and get the details of her HIT. Her HIT may have been caused by another reason.

  94. Hi, kakapunta ko lang po sa nbi U.N. Avenue and applied for my clearance. Ngayon nun turn ko na, lumabas na "with hit"at pinablik ako sa july 15 2014. Kinakabahan po ako kasi nun 15 ako ay nag shoplift ako at nahuli, hindi naman ako dinala sa police station pero parang doon lang sa security office nila. Kinuha lang nila ang name ko, fingerprints, then name ng parents. Ni let go nila ako kasi first time ko daw. Di nman po ako dinala sa dswd or any police station. Out of curiousity po kasi kaya nag shoplift ako. After that po eh naging good boy na ako at nag promise na ako na hindi ko na yun uulitjn. Tinatanong ko lang kung may kaso ako or record ako. Di naman po ako sinampahan ng kaso ng robinson, manila.


    Pls reply po kayo as soon as possible kasi matagal ko nang binubuhat ang problema na ito

Pinapabalik po ako sa july 15 2014, halos maihi-ihi po ako kanina nang makita ko iyon.   97. If you weren't brought to the police station during that day, then it means there was never a case filed against you. Having this in mind, then this incident won't give you a HIT on your NBI records. Your HIT may have been caused by another reason, a "namesake" perhaps. Be sure to return to your NBI kiosk on the date specified so you would know what actually caused your HIT.

  104. May natanggap po akong text galing sa collections agency na ibblacklist nila ako sa mga governtment institutions kasama ang nbi at dfa. Tumawag ako sa telecom at sabi deactivated na nga ung account ko dun at nasa collections na. Di ko tinapos yung phone plan ko pero 2011 pa ata yun o 2012. Kumuha ako ng nbi at pinapabalik ako 1week after dahil hit ng daw. May question is, ano mangyyari? Makukuh ko ba nbi ko? May kaso na ba ako?

  106. If you were a customer who weren't able to pay for the products, then it won't cause a HIT on your NBI records. But if you were an employee of this "direct selling" company, then they may sue you for Estafa or Qualified Theft. These cases may give you a HIT.

  107. Hi sir Emong! I just renewed my nbi earlier and according to them i need tocome back on aug 14 forreleasing. According to the previous questions here, that would only mean that i have a hit. I remember way back 2001 when i issued a check to a lending company and it bounced however way back 2005 i paid the balance however i wasnt able to geta paid in full letter and according to the lending company, they already fileda case on that against me.   116. Hi! I acquired an NBI clearance (for employment) back in May 2014 and was marked with hit. I went through the processed and my name was cleared. My question now is, I will be travelling next month abroad for a short vacation. Do I need to still get an NBI clearance for travel and will I still get a hit? Or no need for me to get one? Btw, the case apparently that the same person with the same name as I am is estafa. Looking forward to getting a quick response from you! :) Have a good day ahead!

  117. Some countries require NBI clearances while some don't. If you're traveling in a country which requires an NBI clearance, I suppose you'll have to get a new one, which says, "FOR ABROAD."



    As to your question if you'll still get HIT -- It depends.
    YES, if your record on your database is not yet updated, and NO, if already updated.

Hi sir, i'd like to ask po, a malicious mischief case was filed against us by our neighbor as my mother had the adjoining wall of our houses (ours and our neighbor's) demolished dahil na-encroach po nila yun portion ng lupa namin. i have been based overseas but have decided to go back to philippines for good. i was not able to attend the hearings and from what i remember, our ex-lawyer mentioned that a bench warrant has already been issued requiring us to appear before the MTC. Kaso hindi po kami sure about this because our lawyer resigned and natatakot po kaming icheck sa court. Now, i am in need of an nbi clearance for my pre-employment. Would you recommend for me to go to nbi to get clearance to find out? or no harm naman po to check with the court hearing our case? Thank you very much

  124. If you have a new lawyer, you can ask him to go to the court and get an update on your case. If none, have somebody -- preferably a next of kin -- to go and check.


    If that warrant still stands, I must advise you to report to that court and post bail so you can have your warrant lifted. Then try your best to have the case dismissed so you can get your NBI clearance.

The only thing na naisip ko was my east west credit card... may nareceive ako na letter nung feb regarding sa fix monthly payment na binabayaran ko nman.. then nung april may tumawag sa office nmin saying na may nagfile ng estafa case against me. Ndi ko nman po pinansin kasi how could i have an estafa case filed against me kung wala nman ako ini-issue na bank checks.

    Pwede po kaya na yun yung hit ko sa nbi kanina? I was told na balilan on wednesday.. sana makuha ko na ung clearance.

  129. Most of the times, an NBI clearance meant for abroad gets an "auto-HIT" meaning you may or may not have an existing case.


    However, if you do have an Estafa case, then this might have caused your HIT. If this is true, I strongly advice that you settle this case to avoid future problems. Return on the date specified so you would know the details of your HIT.

  130. Considering that you already have a valid NBI clearance, the agency will be able to "detect" your civil status even when you apply using your "single" maiden name. Your name, photo and prints will show up, and the NBI staff will be compelled to ask you if you're one and the same.


    There's "consequences" when you tell a lie when getting an NBI clearance. Please be guided accordingly.

  133. Maybe yes, maybe not. If you don't have a pending case then the HIT may be caused by a namesake. Or maybe you're applying for an NBI clearance meant "for abroad" as it usually gets an auto-HIT.

    ask ko lng sana..my utang po ako sa lending na hindi ko na nabayaran.. pero nakikipag usap nmn po ako sa knila,, dahil matagal na nilang client ung company nmn.. but then, they have issued me a demand letter, saying that they have filled a case against me which is "B.P. 22" , my scheduled arraignment is on tuesday (sept.23) and my first hearing will be on the 3rd week of October..

    my question is...can i still get an nbi clearance(for abroad),,

    and possible din po kaya na hindi ako ma-hit..kung hindi pa nmn po ako nakakapunta ng arraignment..

  136. If you're already scheduled for arraignment, then that means your case has already reached the court. This also mean you're gong to get a HIT on your NBI clearance -- whether you attend your arraignment or not.

    Kakauwi ko lang from an NBI office malapit samin and unfortunately, I got a HIT. It's my first time to apply for an NBI clearance. I've gotten 2 police clearances in the past and of course, both are clean. Hindi ako pala labas ng bahay (as in lagi lang ako sa bahay, no work, no school, no reason to go out) at wala naman akong kaso since birth. May nabasa akong comment sa ibang page saying na pati daw same address (I assume address ng isang taong may kaso before) matching your present address ay maaaring magkaka-HIT. Kakalipat lang namin sa new house na to (apartment) nung January, 2014. Possible nga bang yun yung dahilan? Kasi ang weird talaga eh. I have an uncommon surname and a long and unique (or so I thought) first name (3 first names). Wala namang quality control na sinabi. Pinababalik lang ako ng October 2 (7 days from today).


    A little enlightenment will do so much kasi, napapakamot ulo talaga ako.

  138. If you don't have any pending case, then you don't need to worry. No names are too unique. Your first name may be unique, but you may have a namesake on your middle and last names. Or maybe you're applying for an NBI clearance meant :"FOR ABROAD". Nevertheless, return on the date specified and know the details of your HIT.

  141. You weren't able to say if the case is still with the fiscal or if it is already with the court. Nevertheless, these are the two possibilities:


    1. If the case is still under preliminary investigation with the fiscal's office -- NO HIT.
    2. f the case is already filed in an MTC or RTC court -- WITH HIT.

  144. hello po, nangyari po to 1996 po, i was 16 yrs old of age, dahil sa kabaatan ko pa nun nakasuhan ak ng theft, na ipasa po ito sa RTC at nag karon ako warrant of arrest nun panahon na un peo sa takot ndi ako pnag attend ng ng magulang ko, dati nakakakuh ako NBI pa kso nun 3rd time na HIT nko, lagi gnun, peo nakakauha pdin ako, kso nun sumunod ndi na ako nakabalik sa pag kuha NBI, dahil bc sa work , nun kukunin ko na after 3 months aun pinapunta ako QA interview, pnapunta ako sa kung saan un kaso peo ndi na ako nag punta pa, ksi bc sa work, ngyn aalis ako punta iba bansa, ask ko lang mahohold ba ako sa Immigration? my hold departure kya ako, db ang hold departure my expiration 5 yrs po, meron pa kya un? tska ask ko din pde ba kasuhan ang juvenile ng gnun? ndi ko alam kung active pa un kaso ko, paano aayusin ito.. sna matulungan nyo ako.. salamat

  145. 1. RA 9344 or "The Juvenile Act" was only created on 2006 making your theft case in 1996 still effective and can cause a HIT on your NBI clearance.
    2. If you want to know if you have a hold-departure order, you can always go to the Bureau of Immigration and verify your status there.


    The only way to find out if your case still exist is to go to the court of origin and verify its status.

    Kasi po nung 13 years old ako.. Nag shoplift po ako tapos dinala po ako sa police station..
    Tapos tinanung ung nym ko tsaka kinunan ako ng fingerprints.. Tapos inantay lang ung parents ko tapos nakauwi na ako..
    Ask ko po sana kung mag aappeare yun sa nbi ko..
    If ever man po na mag appeare yun anu po gagawin ko?

  147. When the policemen took your fingerprints at the police station, then we can assume that they "booked" you for a THEFT offense. We, however, are not sure if they used that "booking sheet" in filing a case against you. The best way to find out is to apply for an NBI clearance and see if you get a HIT or not.


    If you don't get HIT, then it means they never filed that THEFT case. If you get a HIT, get the details and write me again.

  153. Good day sir emong.. Sir my query is about the subpoena from city prosecutor stating the violation of r.a. 8353 against me by a sexy girl. My mother received the subpoena last June 2014 and to submit counter affidavit and investigation during that time. But due to some reason my mom forgot to tell me or to my wife about the letter..During that time I am working far from home on contract basis.. Bihira mka uwi as amin.. Until this Nov. 2014, naalala ng mom ko bout the subpoena and then sinabi ng wife ko and then told me thru phone.. Until now ng work p rin ako. Na dismaya ako kc Matagal n pala ang subpoena at di nasabi agad sa akin.. This is the first time na nkatanggap ako ng subpoena from city prosecutor. This is in connection of charges filed against me by that sexy at the NBI in the year 2008 of the same violation and submit my counter affidavit during that time at the NBI.. Her accusation Is not true. We have love moment of that sexy girl for several times, ended in breakup and then several months she is complaining me of rape that cause her pregnacy.. I got HIT on my NBI clearance in the year 2012 due to that complain filed at the NBI.. Gusto ko pa sana mg extend ng contract dito as work due to financial need kaya lng nababahala ako.. Marshal n run kami wala communication ng girl n ng complain as akin. Until now Hindi ko pa Alam kung may kaso ako sa court regarding that complain.



    1.. Hindi ako nka attend sa schedule ng city prosecutor.. For some reason pwede kaya ma forward sa court young complain as akin..
    2. Am I liable for the issuance of warrant of arrest? Nangamba ako pg ngpunta ako sa prosecutor any hulihin ako kc did ako nka attend as schedule na dapat mg attend.
    3. Usually, how many subpoena ang ipadala as akin from city prosecutor (Hindi ako mka attend) will be liable for issuance ng arest warrant.
    4. How many months will the city prosecutor handle the case and then forward to court.
    5. Pwede kaya abogado ang pumunta muna sa city prosecutor office..

  154. sir ask ko lang po sana. kase my tinayong business ang magulang ko nung year 1999 then sa SEC nilagay name ko dun at nung older brother ko ng papa ko as a board of director or something na my position kase required daw na 5 ang naka lagay dun so nandun ang magulang ko ako kuya at lola ko. i was 6 y/o pa lang nun ngayon 21 na ko.
    and then last year nalaman namin na may case kami sa SSS dahil hindi na daw nakakapagremit sa SSS aabot daw ng 200K ang babayaran namin.
    pwede po ba ako ma exempted sa case na yun first of all wala ako sa legal age nun and second is wala pa akong SSS.
    hindi pa din ako kumukuha ng SSS sir pati ng NBI clearance
    kaso nung kumuha kuya ko may hit daw pero yun pala may kaso na talaga kami
    pag nakapag pyensa po ba kami sa case namin makakakuha kami ng NBI clearance?

    2. Yes, the prosecutor may file the case in court to issue a warrant for your arrest.
    3. It depends on the prosecutor and the complainant's lawyer.
    4. Because you didn't appear, it will be very easy for the prosecutor to forward the case in court, in a few months maybe.
    5. Yes, your lawyer can represent you.
    6. Yes, you can avail of the PAO's services, just be sure to get a certificate of indigency from your local barangay.


    It's recommended you ask the services of a lawyer to go and check the status of your case.

Their system has the same name, same province where i live. But iam 100%sure na im innocent in any crime.anywhere! I have to get case disposition cetif daw po from RTC caloocan. Pero pumunta po muna ako sa nearest city hall sa amin, sabi po sa legal advice na nakausap ko, need ko lang daw po ng affidavit of denial so they issued me. Okay na po tlaga ung affidavit of denial ? Or i really need to go to rtc? Thanks a lot sir! And im afraid that they might arrest me, what can i say/reason out if ever they try to arrest me though i know that im not that person.?   167. Good day po sir! Would like to share this situation po. Kasi po my friend was caught in a shopping mall for shoplifting. He was brought to the office for settlement. He was told that if he could not pay the item (which was times five the original price), he will brought to the nearest police station and ipapa.blotter daw po. So my friend was able to pay naman but they took his records and also a picture of him. This happened last 2013. And ngayon po ksi ng.apply siya for nbi clearance, he was HIT. Possible po ba na na.forward yun khit na nagbayad xa? And makakakuha pa ba siya ng clearance from nbi? We're kind of puzzled na po on what to do.   168. If the item was already paid, then there's a good chance that a case was not filed against your friend. The HIT may have been caused by another reason -- maybe a namesake perhaps. Tell your friend to return on the date specified so he would know what actually caused his HIT.

    This happened last year. I and my girlfriend was caught doing the deed inside my car by a police during the night. We apologized and police just recorded our names, tel no. and addresses and then let go of us. We were never brought to the police station. We also never received any subpoena's or warrant of arrest in regards to the matter.

    My dilemma now is, my girlfriend was getting her police clearance and it got "hit". She is now asked to go back 2 weeks after. Is it possible that we have a pending case in the court although we never received any subpoena's or warrant of arrests? is the hit due to such act we have done?

Now yung tungkol po sa credit card, diba sa civil case din po yun? Pero may nabasa po ako dito na civil case po yung magiging kaso ko not unless macconvert po nila sa estafa.     The best thing to do is always to do things in good faith. If you can save enough money to pay off your debts, then do so. If you can't, you can always communicate with the credit card company and ask for more time.

    (1) When you're applying for an NBI clearance meant "for abroad," it usually gives you an auto HIT. That's so the NBI staff gets more time to check on your records. (2) Or maybe it's all about a namesake.


    Do return on the date specified so you would know what actually caused your HIT.

    napakalaki na pi ng nagagastos ko kakapabalik balik dahil napakalayo yung nbi sa amin. hanggat maari ayoko po magreklamo sa nangyayari o magtanim ng sama ng loob kasi lahat naman dumadaan dito pero kasi 2am pa lng andun nako twing pupunta, wala nako halos tulog araw aaraw tapos kada punta wala pa din. gusto ko lang po ibahagi na halos linggo na di pa din nawawala lagnat ko magaasikaso pako sa trabaho. malayong probinsya pa po ako manggagaling tapos papupuntahin nila ako sa maynila. kaya po sana mapayuhan niyo po ako, nabasa ko din po kasi sa baba yung tungkol sa affidavit of denial. ano po ba dapat ko gawin? yung branch pa po na nilagay eh paranaque rtc branch 194 na hindi naman nakalagay sa directory nila s website.

  184. The HIT may be a namesake, but you really have to appear at the Paranaque RTC so you can get a certification that it's not you they're after. After getting the certification from the court, you can now submit it to NBI quality control to clear your name. You'll be asked to sign an affidavit for this. And no, you don't have to pay the in-house lawyer when you execute the affidavit.
